FedEx Sues Trump Administration, Demands Full Refund of Illegal Tariff Payments

Last week, the U.S. Supreme Court ruled that President Trump had exceeded his authority by using the International Economic Emergency Powers Act (IEEPA) to unilaterally impose sweeping tariffs on most of the world. The court did not, however, clarify whether businesses that paid tariffs under IEEPA are entitled to refunds leaving billions of dollars in payments unresolved and setting the stage for years of legal battles. Now, FedEx has fired the first major shot. The company filed a lawsuit Monday in the U.S. Court of International Trade, demanding a full refund of all tariff duties paid under IEEPA. FedEx argued that Customs and Border Protection must return all payments made, stating the company "suffered injury caused by those orders." Trade experts predict a flood of similar lawsuits will follow.
